South Dakota VA IRRRL: Read the Homestead Rule First

South Dakota has one rule that can sink a VA streamline if you ignore it: both spouses join on a homestead. Home Loans Inc is not licensed in South Dakota, so this is education to take to a local lender.

Home Loans Inc is not licensed in South Dakota and cannot take a South Dakota application. We lend in South Carolina, North Carolina, Virginia, West Virginia, Florida, Georgia, Alabama, Mississippi, Iowa and Wyoming.

The big one

Both spouses sign. Even if only one is on title.

Most states let a spouse who is not on the deed sit out a refinance. South Dakota does not, at least not on your homestead. South Dakota is a strong homestead state, and on a homestead refinance both spouses must join, or the mortgage can be void under SDCL 43-31-17. That is true even if only one of you is on title.

Void. Not late, not annoying. Void. So if your spouse is deployed, on a long haul, or simply hates paperwork, plan around it now. Your title underwriter confirms what is needed, and remote online notarization is generally available in South Dakota, which can save the day when a signer is far away.

Now the disclaimer I owe you. Home Loans Inc is not licensed in South Dakota. I cannot take your application. This page exists so you understand the streamline well enough to pick a good South Dakota licensed lender and spot a bad one.

Ellsworth to Sioux Falls

The two places most VA loans live

Ellsworth Air Force Base outside Rapid City flies the B-1B Lancer and is set to receive the B-21 Raider. Over in Sioux Falls, Joe Foss Field Air National Guard Base flies F-16s. Those two anchors, plus retirees, drive most of the VA lending in the state.

Sioux Falls

Largest city in the state and the deepest housing market.

Rapid City and Ellsworth AFB

Military-shaped market with moderate sales activity.

Aberdeen

Small town market, not many sales to compare.

Pierre

The capital, and a very small market.

Here is why that matters less than you might think. A VA streamline usually comes without an appraisal, so a ranch outside Aberdeen or a house in Pierre is not punished for having few comparable sales. Purchases and construction loans fight that battle. Your IRRRL mostly skips it.

What VA checks

The streamline in five lines

  • It refinances an existing VA loan into a new VA loan. Nothing else qualifies.
  • Seasoning: the later of 210 days after your first payment was due, or six payments made.
  • Closing costs must be recovered through the monthly savings inside 36 months.
  • There has to be a net tangible benefit, such as a lower rate or a move from adjustable to fixed.
  • You certify you once lived there. An airman who left Ellsworth and kept the house can still qualify.

The VA funding fee on an IRRRL is 0.5%, and anyone receiving VA disability compensation is exempt. VA usually does not require income verification either, though individual lenders sometimes add their own overlays. Ask before you get attached to a quote.

Closing day

How a South Dakota refinance wraps up

A title or escrow company typically handles South Dakota refinances, and there is no attorney mandate. Closings are wet. Funds are wired at signing and held through the rescission window, then the old loan gets paid off.

Costs are friendly. South Dakota does not put a special tax on a refinance, so expect recording fees. No new deed changes hands on a refinance, so there is no transfer tax to fight about.

Two more state rules worth a sentence. South Dakota applies an all-in 36% rate cap, and a loan that violates it can be void. A legitimate VA streamline will be nowhere near that, but it tells you the state takes lending abuse seriously. South Dakota also uses non-judicial foreclosure, and most current first-lien refinances carry no prepayment penalty.

My advice: get the signature plan for your spouse locked first, then shop rate. A great rate on a loan that ends up void is not a great rate.

South Dakota VA IRRRL questions

Why does my wife have to sign if the house is only in my name?

Because South Dakota is a strong homestead state. On a homestead refinance both spouses must join, or the mortgage can be void under SDCL 43-31-17, even when only one spouse is on title. The title underwriter confirms exactly what is required for your closing.

Is an attorney required for a refinance in South Dakota?

No. A title or escrow company typically handles South Dakota refinances, with no attorney mandate. Closings are wet, so funds are wired at signing and held through the rescission window before the old loan is paid off.

We kept our Rapid City house after leaving Ellsworth. Can we streamline it?

Probably, if the current loan is VA. An IRRRL only requires that you certify prior occupancy, so a home you lived in near Ellsworth and later rented out can still qualify, assuming seasoning, recoup and net tangible benefit are met.

Can I apply with Home Loans Inc for a South Dakota IRRRL?

No. Home Loans Inc is not licensed in South Dakota and cannot take the application. Use this page to understand the rules, including the homestead signing requirement, then compare lenders licensed in South Dakota.

Will a small-town South Dakota home struggle to refinance?

Less than you might fear. VA usually does not require an appraisal on an IRRRL, so a home in a market with few comparable sales is not held back the way a purchase might be. Lender overlays can change that, so ask each lender.
