Kansas VA IRRRL: The Streamline Refinance, Sunflower State Edition

How a VA IRRRL plays out in Kansas, from the homestead signature rule to a mortgage tax that no longer exists. Home Loans Inc is not licensed in Kansas, so read this, then go shop a Kansas-licensed lender.

Home Loans Inc is not licensed in Kansas and cannot take a Kansas application. We lend in South Carolina, North Carolina, Virginia, West Virginia, Florida, Georgia, Alabama, Mississippi, Iowa and Wyoming.

Your spouse is signing too. Probably.

Here is the Kansas thing that catches people. Say your name is the only one on the deed. You figure your spouse can skip the signing. In Kansas, maybe not. The state constitution protects the homestead hard, and on a refinance of the home you live in, joint consent is generally required. Translation: a spouse who is not on title typically still signs.

I am not a Kansas lawyer and I am not your Kansas lender. I am a VA guy who has watched closings stall because nobody told the second spouse to show up. Ask early who needs to sign, then clear both calendars. A streamline is supposed to be quick. Do not let one missing signature become the slow part.

And one honest note up top. Home Loans Inc does not hold a Kansas license. I cannot take your application there, and I will not pretend otherwise. What I can do is hand you the playbook, so whichever lender you pick has to earn your business.

Old estimates lie

The mortgage tax Kansas got rid of

Kansas used to charge a mortgage registration tax. It repealed that tax in 2019. A refinance now carries flat recording fees and that is about it. If somebody hands you a cost sheet with a Kansas mortgage tax line on it, the sheet is stale, or it came off a template nobody bothered to update. Either way, make them fix it.

Why this matters on an IRRRL: VA wants your costs paid back by the monthly savings within 36 months. Every bogus dollar on the fee sheet pushes that payback month further out. Lower costs mean faster payback and an easier approval. Phantom tax lines do the opposite.

The closing itself is simple. A title or escrow company runs it, and no attorney is required. Kansas is a wet-funding state, so money generally moves at signing. On your primary residence the federal right-to-cancel window still applies, so the old loan gets paid off once that window closes.

Where Kansas veterans live

Four installations, one rule book

Fort Riley

Junction City and Manhattan, home of the 1st Infantry Division, the Big Red One. A lot of VA loans get written around this post, and every one of them is a future streamline candidate.

Fort Leavenworth

The Army Command and General Staff College in Leavenworth. Officers rotate through on a schedule, so read the PCS section below before you assume you are stuck.

McConnell AFB

Wichita and the KC-46 tanker wing. Wichita runs moderate and affordable, so loan balances tend to be smaller. Smaller balances leave less room for fat fees inside the 36-month test.

Forbes Field

Topeka, home of the Kansas Air National Guard. A Guard member who bought with a VA loan gets the same IRRRL as anybody on active duty.

Kansas City on the Kansas side, Lawrence as the growing college town, Topeka as the capital: the IRRRL rules do not change by zip code. VA usually does not require an appraisal on this loan, so what the house next door sold for is mostly beside the point. Some lenders add an appraisal as their own overlay. Ask.

The PCS question

Moved off post? You can still streamline.

Military families move. You bought near Fort Riley, got orders, and now rent the place out. Good news: an IRRRL only asks you to certify that you lived there before. You do not have to live there now.

The rest of the list is short. The loan you are replacing has to be a VA loan already. You need at least 210 days from your first payment due date and at least six monthly payments made, whichever comes later. The new loan has to give you a real net tangible benefit. The funding fee is 0.5 percent, waived entirely if you receive VA disability compensation. VA usually skips income verification too, although a lender can add it back.

Kansas foreclosure is judicial, prepayment penalties on most current first-lien refinances are limited mainly by federal rules, and remote online notarization is generally available. That last one is handy if you are already at the next duty station.

Four questions for any Kansas lender

  • Show me a fee sheet with recording fees only, no mortgage tax.
  • Tell me the exact month my savings pay back the costs.
  • Which overlays do you add on top of VA: appraisal, income, credit?
  • Given the homestead rule, who has to sign at closing?

A Kansas-licensed lender who answers all four without squirming deserves a closer look. One who dodges the second question is telling you something.

Kansas VA IRRRL questions

Does my wife have to sign our Kansas IRRRL if only my name is on the deed?

Generally yes. Kansas protects the homestead in its constitution, and a refinance of the home you live in usually needs joint consent. A spouse who is not on title typically signs anyway. Confirm it with your Kansas lender and the title company early so nobody is surprised at the table.

Is there still a mortgage registration tax on a Kansas refinance?

No. Kansas repealed the mortgage registration tax in 2019, so a refinance now carries flat recording fees. If an estimate still shows a mortgage tax line, it is out of date. Ask the lender to correct it before you compare offers, because inflated costs make the 36-month recoupment test harder to pass.

Can Home Loans Inc handle my Kansas streamline?

No. Home Loans Inc is not licensed in Kansas and cannot take a Kansas application. Treat this page as education. Use it to compare offers from lenders who are licensed in Kansas, and ask each of them the same questions so their numbers line up side by side.

I bought near Fort Riley and rent the house out since my PCS. Can I still do an IRRRL?

Usually yes. A VA IRRRL only requires you to certify that you previously lived in the home, not that you live there today. The existing loan must be a VA loan, you need the 210-day and six-payment seasoning, and the new loan has to show a net tangible benefit.
